Taking a Conveyance without Owners Consent (TWOC)

Theft Act 1968 s12(1)

A person shall be guilty of an offence if, without having the consent of the owner or other lawful authority, they take any conveyance for their own or another’s use, knowing that any conveyance has been taken without such authority, drives it or allows themselves to be carried in or on it.

Aggravated Vehicle-Taking

Theft Act 1968 s12A(1) & (2)

(1) A person is guilty of aggravated taking of a vehicle if:

They commit an offence under s12(1) in relation to a mechanically propelled vehicle, AND

It is proved that, any time after the vehicle was unlawfully taken (whether by them or another) and before it was recovered, the vehicle was driven or injury was caused, in one or more of the circumstances set out in paragraphs (a) to (d) of subsection (2)

The circumstances referred to in subsection (1)(b) are:

that the vehicle was driven dangerously on a road or other public place

that, owing to the driving of the vehicle, an accident occurred by which injury was caused to any person

that, owing to the driving of the vehicle, an accident occurred by which damage was caused to any property, other than the vehicle

that damage was caused to the vehicle.

Pedal Cycles

Theft Act 1968 s12(5)

Taking a conveyance shall not apply to pedal cycles; but a person who, without having the consent of the owner or other lawful authority takes a pedal cycle for their own or another’s use, or rides a pedal cycle knowing it to have been taken without such authority, shall be guilty of an offence.

Vehicle Interference

Criminal Attempts Act 1981 s9

(1) A person is guilty of the offence of vehicle interference if they interfere with a motor vehicle or trailer or with anything carried in or on a motor vehicle or trailer with the intention that an offence specified in subsection (2) shall be committed by themselves or some other person.

(2) The offences mentioned in subsection (1) are:

Theft of a motor vehicle or part of it

Theft of anything carried in the motor vehicle or trailer, and

An offence under section 12(1) of the Theft Act 1968 (taking a conveyance)

And if it shown that a person accused of an offence under this section intended that one of those offences should be committed, it is immaterial that it cannot be shown which it was.
